These Terms of Service ("Terms") govern your access to and use of weatherworkbench.com (the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

What this site is

Weather Workbench is a free informational workspace that aggregates publicly available weather, climate, and energy data products and organizes them by U.S. independent system operator (ISO) and regional reliability footprint. The Site is not affiliated with any ISO, RTO, utility, federal agency, or commercial weather data vendor.

Informational use only — not professional advice

The Site and all content on it are provided for general informational purposes only. Nothing on the Site constitutes professional advice of any kind, including but not limited to meteorological, emergency, safety, medical, legal, financial, trading, investment, or operational advice. You should not rely on the Site as the sole basis for any decision and should consult appropriate qualified professionals and primary official sources for any decision that could affect health, safety, property, or financial outcomes.

Life-safety warning

Weather Workbench is not an emergency notification service and must not be used as the basis for life-safety decisions. For severe weather, evacuations, shelter instructions, and any time-critical safety determination, consult your local National Weather Service forecast office at weather.gov, the National Hurricane Center at nhc.noaa.gov, and your local emergency management authority.

No warranties

THE SITE AND ALL CONTENT, DATA, FORECASTS, MAPS, ALERTS, AND OTHER MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, AND UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that data displayed on the Site is current, accurate, or complete, and we make no representation that the Site will be available at any particular time.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WEATHER WORKBENCH, ITS OPERATORS, CONTRIBUTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

No duty of care

Nothing in these Terms or in your use of the Site creates any fiduciary, advisory, professional, monitoring, alerting, or other duty of care owed by Weather Workbench, its operators, contributors, or licensors to you or to any third party. We have no obligation to monitor, verify, validate, correct, supplement, update, or warn about any data, content, condition, event, or change displayed on or absent from the Site.

Data latency, integrity, and completeness

The Site aggregates and caches data from multiple upstream sources on scheduled refresh intervals. Data displayed on the Site may be stale, delayed, cached, partial, missing, out of order, inconsistent with the source of record, or different from what the upstream provider is currently publishing. We do not guarantee any particular refresh frequency, retention period, or data fidelity. Cache age indicators, "last updated" timestamps, and similar markers are provided for informational convenience only and may themselves be inaccurate. For any decision that depends on real-time or authoritative data, you must consult the original source directly.

Third-party outages and changes

The Site depends on third-party data providers, hosting infrastructure, content delivery networks, advertising networks, analytics providers, and other external services that we do not control. These providers may experience outages, latency, degraded data quality, format changes, URL changes, deprecations, paywalling, access restrictions, or discontinuation at any time and without notice. We are not responsible or liable for any unavailability, error, delay, change, removal, or malfunction of any third-party service or data, including any U.S. or foreign government source, ISO/RTO source, satellite or model imagery source, hosting or network provider, or advertising or analytics provider.

Force majeure

We are not liable for any failure, delay, suspension, or interruption of the Site or of any data displayed on the Site that is caused by events beyond our reasonable control, including but not limited to: acts of God; severe weather, fire, flood, or other natural disasters; war, terrorism, civil unrest, or government action; pandemics or public-health emergencies; labor disputes; failures or interruptions of the public internet, electrical grid, telecommunications networks, hosting providers, or content delivery networks; failures, errors, or discontinuation of third-party data sources or government services; cyberattacks or other malicious third-party conduct; and changes in law, regulation, or government policy.

User responsibility

You are solely responsible for your use of the Site and for any decision, action, or inaction you take based on or in connection with anything you see, read, infer, or fail to see on the Site, including without limitation any trading, hedging, dispatch, scheduling, operational, planning, communications, safety, or risk- management decision. You are responsible for independently verifying any data, forecast, alert, or characterization on the Site against authoritative primary sources before relying on it. You assume all risk arising from your use of the Site.

Third-party content and links

The Site displays, embeds, and links to data, imagery, and content sourced from third parties, including but not limited to the National Weather Service, NOAA, the Climate Prediction Center, the National Hurricane Center, the U.S. Drought Monitor, the U.S. Energy Information Administration, public meteorology providers, and geostationary satellite imagery sources. All such third-party content remains the property of its respective owner and is subject to the owner's terms of use. We do not endorse, control, or guarantee the accuracy or availability of third-party content, and we are not responsible for any third-party site or service.

Acceptable use

You agree not to:

  • use the Site in violation of any applicable law or regulation
  • attempt to hack, probe, disrupt, overload, or otherwise interfere with the Site or its underlying infrastructure
  • scrape, crawl, harvest, or systematically copy the Site or its data in a manner that imposes an unreasonable load or violates applicable law
  • misrepresent your identity or affiliation, or impersonate any person or entity
  • remove, obscure, or alter any copyright, trademark, or attribution notice on the Site
  • use the Site to transmit malware, spam, or other harmful or unlawful content

Intellectual property

The original written content, layout, design elements, and code on the Site are owned by the operators of Weather Workbench, except for third-party content which remains the property of its respective owners. Government works (including most National Weather Service and NOAA outputs) are generally in the public domain in the United States but may carry attribution requirements. You may quote short excerpts of original Weather Workbench written content for non-commercial, informational purposes with clear attribution and a link back to the source page.

DMCA / copyright complaints

If you believe content on the Site infringes your copyright, please send a written notice to contact@weatherworkbench.com including: (1) identification of the copyrighted work claimed to be infringed; (2) the URL or location on the Site of the allegedly infringing material; (3) your contact information (name, address, telephone, email); (4) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; and (6) your physical or electronic signature. We will respond to valid notices in accordance with the U.S. Digital Millennium Copyright Act.

Indemnification

You agree to indemnify, defend, and hold harmless Weather Workbench, its operators, contributors, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of any third party.

Governing law and venue

These Terms and any dispute arising out of or related to the Site or these Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Delaware will have exclusive jurisdiction and venue over any such dispute, and you consent to personal jurisdiction in those courts.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in full force and effect.

Reservation of rights to modify or remove content

We reserve the right, at our sole discretion and at any time, to add, change, correct, suspend, restrict access to, deprecate, or permanently remove any feature, page, dataset, article, image, link, ISO coverage, or other content on the Site, with or without notice and with no liability to you or to any third party. We may also discontinue the Site in whole or in part at any time. Any reliance you place on the continued availability of any specific feature, dataset, or content is at your own risk.

Changes to these Terms

We may update the Site or these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Your continued use of the Site after a revision constitutes acceptance of the updated Terms.
